Labour Hire – No Delegation of OH&S
In yet another prosecution decision, the South Australian Industrial Relations Commission has fined a business in respect of an employee of a labour hire business, who was injured.
Employers must understand that you cannot delegate out OH&S responsibilities in respect of labour hire employees. The Employer who engages a labour hire business must induct the labour hire employee, execute and follow its safety management system and also take reasonable practicable steps to avoid foreseeable injury to the labour hire employee.
